How can creditors in Michigan collect on unpaid debts?

Collecting unpaid debts can prove challenging, but Michigan law offers creditors several legal methods to recover the money owed. Understanding these options is crucial for effective collection and compliance with the law.

Send a demand letter

Start by sending a formal demand letter. The letter should clearly state the amount owed, payment terms, and other details about the debt. A well-written letter often encourages the debtor to settle without further legal action.

File a lawsuit

If the debtor refuses to pay, you may need to file a lawsuit. In Michigan, you’ll file the claim in district or circuit court, depending on the debt’s size. Once the court rules in your favor, it will issue a judgment, allowing you to pursue additional collection steps.

Wage garnishment

After obtaining a judgment, you can request wage garnishment. This action involves your debtor’s employer withholding a portion of their wages and sending it directly to you. Michigan law limits the amount you can garnish based on the debtor’s income.

Bank account garnishment

You can also seek bank account garnishment. Once you have a court order, you can access funds directly from the debtor’s account. To use this method, you’ll need to know the debtor’s banking details.

Property liens

You can place a lien on the debtor’s property, preventing them from selling or refinancing it until the debt is settled. Liens can apply to both real estate and personal property, and you can eventually force the sale of the property to recover the owed amount.

Collections agency

If other methods don’t work, you can hire a collections agency. These agencies specialize in debt recovery, using their expertise to track down and collect outstanding debts. However, they charge fees for their services.
