Avoiding common estate planning issues in Michigan

On Behalf of Bieber & Czechowski, PLLC | Feb 1, 2022 | Estate Planning

Estate planning is a great way to ensure that your assets reach your heirs and are passed down according to your wishes. However, it can get messy if you don’t take the right steps or make errors along the way. To avoid any estate planning mess, do the following:

Don’t omit or disregard legal documents

There are many legal documents that are necessary for a successful estate plan. Some of them include trusts, wills and powers of attorney. If you omit or disregard any of these documents, it could lead to a lot of confusion and conflict after your death. For instance, if you don’t have a will, the state may decide how your assets are distributed instead of following your wishes, potentially leading to conflict among your heirs.

Make sure you update your documents regularly

It’s important to make sure that you update your estate planning documents regularly, especially as your life changes. For instance, if you get married or divorced, have children or change your mind about who should inherit your assets, you’ll need to update your will or trust. Otherwise, your documents may not reflect your current wishes and could lead to problems down the road.

Communicate with your heirs

It’s also important to communicate with your heirs about your estate plan. This way, they’ll know what to expect after you’re gone, and there won’t be any surprises. You should make sure that your executor and other key people involved in the process are aware of your wishes.

Appoint the right people

From trustees and executors to people bearing the power of attorney designation, there are a lot of important people that estate planners appoint to help carry out their wishes. It’s important to choose the right people for these roles as they’ll be responsible for ensuring that your estate gets handled properly.

These are just a few tips to help keep your estate planning process as smooth and conflict-free as possible. With a bit of planning, it is possible to have a successful estate plan.
